DMCA Policy
Claire Chazal Nostalgique respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Claire Chazal Nostalgique service and/or website (the "Site") if such claims are reported to our Designated Copyright Agent identified below.
Filing a DMCA Notice
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.
Upon receipt of the Notice as described below, Claire Chazal Nostalgique will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.
- Identification of the copyrighted work claimed to have been infringed: Provide sufficient detail, or a link to the original work.
- Identification of the material that is claimed to be infringing: Provide detailed information including where the material is located on the Claire Chazal Nostalgique Site (e.g., URL link).
- Your contact information: Include your full legal name, mailing address, telephone number, and email address.
- A statement of good faith belief: Include the statement: "I have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."
- A statement that the information in the notification is accurate: Include the statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
- Your physical or electronic signature: A true signature (or an electronic signature as permitted under applicable law).
Filing a DMCA Counter-Notification
If you believe that your content, which was removed or disabled, is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a counter-notification containing the following information to our Designated Copyright Agent:
- Identification of the material that has been removed or to which access has been disabled: Provide the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury: Include the statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
- Your name, address, and telephone number.
- A statement consenting to the jurisdiction of the federal district court: Include the statement: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside of the United States, for any judicial district in which Claire Chazal Nostalgique may be found, and I will accept service of process from the person who provided the original notification of the alleged infringement."
